Dear Housing Choice Voucher Landlords and Voucher Participants:
As you are aware, the Section 8 Housing Choice Voucher (HCV) program is a federally-funded program. HAMC receives its funding to administer the HCV program from the U.S. Department of Housing and Urban Development (HUD). Due to the lapse in Congressional Appropriations for Fiscal Year 2019, the federal government was shutdown on December 22, 2019, and HUD was directly affected. The federal government has been reopened until Friday, February 15, 2019. HAMC’s Housing Choice Voucher program received full funding for February 2019 HCV payments, and has been advised we will receive March 2019 HCV payments as well. February payments will be processed immediately. We anticipate March payments to be made on time as well. However, on this date, it is unclear whether there will be full funding for April 2019 and beyond payment.
This letter serves as formal notification to you that potentially and due to circumstances beyond HAMC’s control, namely a U.S. federal government shutdown, Housing Assistance Payments and Utility Assistance Payments for April 2019 and beyond may not be issued as expected.
Voucher Participants: Please be advised you continue to be responsible for on time payment of your portion of your rent to your Landlord.
Landlords: Please be advised the Voucher Participant/Tenant is not responsible for paying the portion of rent to owner covered by HAMC’s housing assistance payment under the contract between you and HAMC. HAMC’s failure to pay the housing assistance payment to the owner is not a violation of the lease. The owner may not terminate the tenancy for nonpayment of HAMC’s housing assistance payment. Additionally, HAMC is not obligated to pay any late payment penalty when late payment is due to factors beyond HAMC’s control.
It is HAMC’s expectation that should there be any missed payments to landlords on behalf of voucher participants, they will be paid and regular payments resume as soon as issues of the federal government shutdown is resolved, and funds are released by HUD to HAMC.
